A: General purchase conditions

1. Legal relations and legal relations participation

1.1 The following conditions are for all legal relations between REMEDIANA®Group s.r.o. (hereinafter “Seller”), and buyers regardless of being persons or legal entities. It takes into account and apply only the conditions given by the seller- personal conditions of performing business by the buyer are not taken into account unless it is entered into agreement.

1.2  In these conditions in terms of consumers is considered to be every person that concludes legal business for the purpose not including entrepreneurship. An entrepreneur is a person or legal entity that concludes agreement within his entrepreneur activities.

2. Conclusion of the contract

2.1 All presented products (images) in on-line shop of the seller, do not represent an offer  by the seller but are for the purpose of information on which basis the buyer offer seller an agreement conclusion on chosen product.

2.2  Buyer can submit an offer via form in our on-line shop by filling in data into integral form for product order. Filling in his personal data and by the last click (send), the buyer finishes the legal business of his offer in relation to ordered product.

2.3 The seller may accept the buyer’s offer within two days in the following way:

By written confirmation that the order on agreement conclusion on chosen product is received (fax or e-mail) from the buyer in which the level of offer validation and confirmation is estimated by the seller.

By delivery of the chosen product on the buyer’s address.

By sending written payment order to the buyer for the chosen product. If all the alternatives show as unrealized seller withdraws from the agreement. If the seller fails to provide the buyer the product within the specified time, it will be considered as a rejection of the bid with the result that the customer no longer binds his statement about the purchase.

2.4 The period for offer acceptance starts immediately on the day of sending the offer by the buyer and ends at the closing of the following day as of the offer arrival. If it is on Saturday or Sunday as last day, or public holiday, then the last day goes to the first working day.

2.5 The order and contacts you send are processed by automatic order processing. The buyer has to provide correct e-mail address, that on this mail seller can send information. The buyer has to provide by SPAM-FILTER which massages are junk or he himself is responsible for all the massages that he sent together with the order.

3. Return of the delivery

3.1 If the customer uses his right to return the product without explanation, regular costs of return are on the behalf of the customer if the prices of the returned goods are less than 92 EUR. If ordered goods is of higher value and were not delivered within specified period, the costs of return are on the seller.

4. Price and payment

4.1 The given prices are final with included VAT, if necessary, additional costs of shipment and delivery will be given together with the product description.

4.2 Buyers may choose different payment options that are given in online shop.

4.3 The goods are delivered upon agreement conclusion (after the payment is performed)

5. Delivery and shipment conditions

5.1 The products are delivered on the address that the buyer put into the form. During the transaction, that is money payment, the delivery address that you stated is the authoritative for the seller. As for the PAYPAL payment, the authoritative is the address you stated when paying.

5.2 In situation transportation company is unable to deliver the ordered goods on buyer’s stated address (for example incorrect address, address change) and the products are returned to the seller, than the costs of failed delivery are on the customer. It is in situation when the buyer accepted his right on goods return but did not insure the circumstances for taking over of ordered products, i.e from any reason was temporarily prevented to accept the ordered products. This is not in the case when the buyer in advance announces to the transportation company or the seller that in due time he will not be able to provide situation for acceptance of ordered products on the form given address.

5.3 The existing risk of accidental loss and damage for the sold product is on the behalf of the buyer and it is confirmed by product taking over. If the buyer is entrepreneur, the situation of accidental loss and deterioration of the products during delivery is on the behalf of the transportation company that transported the goods to  he place of buyers business, in this case an entrepreneur.

5.4 The seller reserves the right to withdraws from the agreement with the consumer without stating the reason in case of wrong or incorrect delivery of ordered product to the buyer via transportation company. This is does not apply if seller personally delivers the ordered products to the buyer and personally controls the whole delivery process. In case of incorrect and wrong delivery, the seller shall do everything to deliver the ordered goods in due time. In case of unavailability of ordered product, the buyer shall be immediately notified by the seller and be refunded the amount paid when ordering the goods.

5.5 Personal take over of bought products is not possible due to logistic reasons.

6.1 Legal responsibility for defects.

7. Legal rights

7.1 The Law of Republic of Slovakia, not taking into account Laws on International Goods Selling, are applied on all legal relations between parties. The choice of laws is done for the consumers if the protection on compulsory provisions is abolished in the state of customer’s residence.

7.2 If the customer is trader, public person, legal entity or person residing or having domicile in Republic of Slovakia, all disputes that may arise between seller and buyer in the process of ordering, paying and delivery of products are to be solved in front of the competent court of Republic of Slovakia territory. If the buyer is domicile or resides on territory out of Republic of Slovakia, all disputes are also solved in front of the competent court in Republic of Slovakia determined according to the Company REMEDIANA Group, s.r.o. headquarters. Seller in case of dispute has the right, in the above stated situations,  to call the competent Court where the Buyer filed the complaint, indictment and to personally inform on the proceeding. By ordering and paying the product, buyer accepts and agrees on here in above rights stated in 7.2.

5.1 The consumer has to perform several technical steps to fulfill the criteria for shipment of the goods. Those are the following steps:

5.1.1 To chose the product and add it (read it) into the virtual basket
5.1.2  To log in the online shop entering user name and password and if you do not have account you have to register entering your data in appropriate form.
5.1.3  Enter the correct address for delivery
5.1.4  Chose the option for goods delivery

5.2 Accepting the order by the seller is regulated in Article 2.3 (see seller’s conditions).

6.Information on agreement text storing

The agreement shall be saved after conclusion between buyer and the seller and sent to the buyer in text form (for example text or e-mail). The agreement text shall be stored on website of REMEDIANA and can be downloaded free by the buyer on his account which is protected by password  determined by the buyer) and if the buyer opened it in the online shop prior the submitting the request for the product purchase.

7.Information on technical mistakes correction

Before submitting the order, the user may correct his technical mistakes using standard functions of the mouse and keyboard. Besides, all items before compulsory sending of the order shall be shown in one window and may be corrected with standard functions of the mouse and keyboard.

1 Payment options 

1.1 For delivery of products to Slovakia, we offer the following payment options as described in the product description, unless the offer specifies otherwise:

2. Delivery 

2.1  Depending on the size of your order, ordered products will be sent by transport company, fast post or similar.

2.2 We send products all over the world. If you wish sending the goods, send us an e-mail to: info@remediana.com and write the correct data, delivery address, state and postal code and also name of required product quantity. We will immediately answer you by an e-mail in connection to your order, organize transport and etc. At the same time we will inform you about payment and final price of the ordered product with delivery to required address. If you want to know if the transport is possible to your country, contact us on info@remediana.com

3 Shipping costs 

3.1 For shipments within Slovakia, we charge the delivery cost as a flat rate for order of 3.80 EUR per delivery. If the value of ordered goods exceeds 80 EUR then the transport costs are provided by seller.

3.2 For delivery within EU we charge the delivery cost as a flat rate for order of 6,90 EUR for secured deliveries. If the value of ordered goods exceeds 92 EUR then the transport costs are provided by seller.

3.3 For delivery to other countries we charge the delivery cost depending on the size of your order and destination as stated at section 2.2 of this paymant, shipping and deliver conditions.

4 Term of delivery

The term of delivery is 5-7 working days in EU. On Saturdays, Sundays and public holidays deliveries are not done. If the ordered product is not on the stock, the time of delivery will be appropriately extended.

5 Information on product return

Buyer as a person, has the right to return the product without giving a reason of return, if the buyer is a natural person who enters into a legal contract with the seller and the product is for his independent professional activity, not for commercial activities of the buyer.

6 Right to product return

The buyer as a person may cancel the agreement and return product within 14 days as of the day of delivery without giving reasons for return – in writing (for example e-mail or fax) and by sending the product back to the seller in original package within 14 days from the time of delivery. The term starts as of the day of receiving the instructions in writing text, but not before the product receiving. Besides recall and right to product return, it is enough to indicate in writing and simply send it back to the seller. The recall has to be sent to e-mail: info@remediana.com and product has to be sent within 14 days of receipt of the product to the postal delivery address: REMEDIANA Group, Ondavská 12, 821 08 Bratislava, Slovakia.

7 Consequences of Product Return

In case of efficient recall of both parties, the customer shall be paid money back. We offer you some benefits (for example possibility of use the recall right without reason), but if you do not return the product in one part, or return it in worse condition that it was delivered to you, as a client you will be obliged to pay the compensation. For damaging during use, you are obliged to pay compensation which according to the agreement exceeds testing and characteristic of functioning. Under “testing and characteristic of functioning” is considered testing and trial of the goods for the possibilities in the shop. You will have to pay difference between undamaged and damaged condition of the product if the returned product is damaged or partially damaged. Otherwise the return of goods is free of charge for you. Liabilities on compensation payment are to be completed within 30 days. The payment period starts as of the moment of sending back the goods, and for us as of the receiving it.

D General informations

1. Please, prevent product damage. Send the goods back to us if possible in original package with all additions and package components. If necessary use the protective package. If you do not have the original package, we would appreciate it if you could provide appropriate package for protection from damage during transport.

2. Send the goods directly to us if possible. We will refund expenses if necessary for the postal costs paid in advance, except if the costs are to be paid by you.

3. Note that the quoted points 1 and 2 are not precondition for effective achieving the right to withdraw from the contract.

A. Všeobecné obchodné podmienky (VOP)

1 Predmet

1.1 Tieto Všeobecné obchodné podmienky “REMEDIANA® s.r.o.“ (ďalej len “predávajúci”), platia pre všetky zmluvy, ktoré spotrebiteľ alebo obchodník (ďalej len “kupujúci” ) uzatvára s predávajúcim v jeho on-line obchode za tovar a / alebo služby tam uvedené. Zmluva neberie do úvahy vlastné podmienky kupujúceho, pokiaľ nie je dohodnuté inak.

1.2 Kupujúcim v zmysle týchto Všeobecných obchodných podmienok sa rozumie akákoľvek fyzická osoba, ktorá pri uzatváraní a plnení kúpnej zmluvy podľa týchto VOP nekoná v rámci predmetu svojej podnikateľskej činnosti, zamestnania alebo povolania. Predávajúcim v zmysle týchto Všeobecných obchodných podmienok sa rozumie každá fyzická alebo právnická osoba, ktorá vstupuje do právneho úkonu v rámci svojej podnikateľskej činnosti.

2 Uzavretie zmluvy

2.1 Prezentácia produktov v internetovom obchode predávajúceho sa nepovažuje za záväznú ponuku zo strany predávajúceho, ale slúži ako podklad pre záväznú ponuku zo strany kupujúceho.

2.2 Kupujúci môže predložiť ponuku prostredníctvom internetového obchodu predávajúceho cez integrovaný on-line objednávkový formulár. Týmto kupujúci po zadaní svojich osobných údajov a kliknutí na tlačidlo objednávkového procesu zasiela predávajúcemu záväznú ponuku na uzavretie zmluvy na produkt obsiahnutý v nákupnom košíku.

2.3 Ponuku na uzavretie zmluvy od kupujúceho potvrdí predávajúci v priebehu dvoch dní jedným z troch nasledovných spôsobov: písomným potvrdením (fax alebo e-mail), alebo zaslaním produktu na adresu kupujúceho, alebo žiadosťou o úhradu zo strany kupujúceho za objednaný produkt.

Zmluva je uzatvorená v okamihu, kedy nastane jedna z vyššie uvedených alternatív.

V prípade, že predávajúci neprijme ponuku od kupujúceho vo vyššie uvedenej lehote, má sa za to, že ponuka bola predávajúcim odmietnutá a kupujúci už nie je viazaný svojím prejavom vôle.

2.4 Lehota na prijatie ponuky začína plynúť hneď nasledujúci deň po odoslaní ponuky zo strany kupujúceho a končí sa uplynutím 48 hodín. Ak pripadne niektorý deň z tejto lehoty na sobotu, nedeľu alebo celoštátne uznávaný štátny sviatok na mieste predávajúceho, lehota sa o tento deň posúva na nasledujúci pracovný deň.

2.5 Spracovanie objednávky a kontakt sa realizuje zvyčajne prostredníctvom e-mailu alebo automatizovaným spracovaním objednávok. Kupujúci musí zabezpečiť, aby ním zadaná e-mailová adresa bola správna, a aby na tejto adrese mohol prijať e-mail od predávajúceho. Kupujúci musí zabezpečiť spamovú filtráciu (aby sa mail od dodávateľa nedostal do spamového koša).

3 Náklady za vrátenie tovaru

Predávajúci znáša náklady za vrátenie tovaru iba v prípade, že dodaný tovar nezodpovedá objednávke kupujúceho. Vo všetkých ostatných prípadoch znáša náklady na vrátenie tovaru kupujúci.

4 Ceny a platby

4.1 Ceny uvedené predávajúcim sú konečné a zahŕňajú DPH. Ďalšie dodacie a prepravné náklady sú dodatočne vyčíslené v popise výrobku.

4.2 Zákazník má niekoľko platobných možností, ktoré sú uvedené v internetovom obchode predávajúceho.

4.3 Je možná iba platba vopred alebo zaslanie na dobierku.

5 Dodacie a prepravné podmienky

5.1 Dodanie tovaru sa uskutočňuje na pravidelných trasách a na dodaciu adresu uvedenú kupujúcim. Pre dokončenie nákupnej transakcie je rozhodujúca správne zadaná doručovacia adresa kupujúceho.

5.2 Ak dopravná spoločnosť zašle produkt predávajúcemu späť z dôvodu neúspešného doručenia, kupujúci znáša náklady neúspešného doručenia. To neplatí v prípade, ak kupujúci odmietne prebrať produkt z dôvodu zaslania iného produktu ako objednal a týmto si uplatňuje svoje právo na vrátenie produktu.

5.3 Zodpovednosť za produkt, za poškodenie, prípadne za stratu produktu prechádza z predávajúceho na kupujúceho prevzatím produktu. V prípade, že kupujúci je podnikateľ, firma , prechádza zodpovednosť náhodnej straty a náhodného poškodenia produktu na prepravnú spoločnosť.

5.4 Predávajúci si vyhradzuje právo nedodať tovar v danom dodacom termíne v prípade, že produkt je momentálne nedostupný a zároveň sa zaväzuje podniknúť všetky potrebné kroky, aby čo najrýchlejšie poslal objednaný produkt kupujúcemu. Predávajúci sa zároveň zaväzuje ihneď informovať kupujúceho o prebiehajúcom procese. V prípade nedostupnosti produktu, alebo len čiastočnej dostupnosti produktu, bude zákazník bezodkladne informovaný a peniaze bezodkladne vrátené na účet kupujúceho.

5.5 Osobný odber  je možný.

6 Zodpovednosť za vady

Zákonná zodpovednosť za vady.

7 Rozhodcovské právo

7.1 Na všetky právne vzťahy medzi zmluvnými stranami sa vzťahuje zákon Srbskej republiky s výnimkou zákona o medzinárodnej kúpe pohyblivého tovaru.

7.2 V prípade, že kupujúci je obchodník, právnická osoba alebo verejnoprávny činiteľ so sídlom na území Slovenska republiky, jediným miestom súdu pre všetky spory vyplývajúce z tejto zmluvy je sídlo predávajúceho. Ak má kupujúci sídlo mimo územia Slovenska, platné miesto súdu je sídlo predávajúceho okrem mimoriadne uzavretých dohôd. V takom prípade je kupujúci oprávnený informovať sa na súde predávajúceho o prebiehajúcom procese.

7.3 Zmluvný jazyk je slovenský.

5 Informácie o technických krokoch vedúcich k uzatvoreniu zmluvy

Kupujúci na predloženie svojej ponuky musí prejsť nasledujúcimi technickými krokmi cez on-line objednávkový formulár predávajúceho:

5.1 Prijatie objednávky zo strany predávajúceho je v súlade s odsekom 2.3 časti A Všeobecných obchodných podmienok (viď vyššie).

6 Informácie o ukladaní zmlúv

Po zaslaní objednávky zo strany kupujúceho sa zmluvný text ukladá u predávajúceho a spolu s priloženými VOP a ostatnými zákazníckymi informáciami sa zasiela naspäť kupujúcemu v potvrdzujúcom písomnou texte (mail / fax).

Navyše sa text zmluvy archivuje na web stránke predávajúceho a kupujúcemu umožňuje použitím jeho užívateľského mena a hesla náhľad do jeho užívateľského konta.

7 Informácie o použití technických prostriedkov na spoznávanie a opravu preklepových chýb

Pred odoslaním objednávky si zákazník môže opraviť svoje údaje pomocou štandardnej klávesnice a myši. Následne sa všetky zadané údaje zobrazia v potvrdzujúcom okne, kde sa použitím štandardnej klávesnice a myši všetky chyby dajú opraviť.

Pre kupujúcich zo Slovenskej republiky je pre zmluvu určený slovenský jazyk.

C. Platba, dodanie a doprava

1 Platobné možnosti

Pre dodávku produktov na Slovensku ponúkame nasledujúce možnosti platby uvedené v popise výrobku, ak ponuka neustanovuje inak:

– V hotovosti vopred

– Platba na dobierku

– PayPal

2. Dodanie

2.1 Produkt bude dodaný ihneď v závislosti na veľkosti objednávky.

2.2 V prípade, že sa jedná o medzištátnu prepravu mimo Európy, prosíme kontaktujte nás mailom na adrese info@remediana.com a zadajte prosím položku s objednaným množstvom, presnú doručovaciu adresu (ulica, číslo domu, mesto) a zodpovedajúce PSČ. Obratom vám dáme vedieť, či môžeme zásielku zaslať aj do vami určenej krajiny a vyčíslime poštovné náklady.

3 Poštovné náklady

3.1 U zásielok v rámci Slovenska účtujeme náklady na doručenie ako paušálnu sadzbu na objednávku v hodnote 3,80 EUR za doručenie. Ak je hodnota objednávky viac ako 80,00 EUR, poštovné náklady kupujúcemu neúčtujeme, t.j. platí ich predávajúci.

3.2 U zásielok mimo SK v rámci Európy účtujeme náklady na doručenie ako paušálnu sadzbu na objednávku v hodnote 6,90 EUR za doručenie. Ak je hodnota objednávky viac ako 92,00 EUR, poštovné náklady kupujúcemu neúčtujeme, t.j. platí ich predávajúci.

3.3 Pre doručenie do iných krajín mimo EÚ účtujeme náklady na doručenie v závislosti od veľkosti vašej objednávky a cieľovej destinácie, ako je to uvedené v bode 2.2 tejto časti C. 

4 Dodacie podmienky

4.1 Dodacia lehota je cca 5 pracovných dní v rámci EÚ (nepočítajú sa soboty, nedele a sviatky).

Ak objednaný produkt momentálne nie je dostupný, alebo nie je skladom, dodacia lehota sa primerane predĺži.

5 Právo na vrátenie tovaru

Kupujúci má právo odstúpiť od zmluvy v prípade, ak je kupujúci fyzická osoba, ktorá vstupuje do právneho úkonu za účelom, ktorý nemožno definovať ako komerčný, ani týkajúci sa jeho nezávislej profesionálnej činnosti.

6 Právo na zrušenie zmluvy

Kupujúci môže zrušiť svoju objednávku do 14 dní od doručenia produktu bez udania dôvodu nasledovne:

– písomnou formou: zrušenie zmluvy musí byť zaslané písomne na e-mail adresu: info@remediana.com         a
– zaslaním produktu v lehote do 14 dní od prevzatia produktu na poštovú doručovaciu adresu: REMEDIANA® Group s.r.o., Ondavská 12, 821 08 Bratislava, Slovensko

7 Dôsledky zrušenia zmluvy

V prípade odstúpenia od kúpnej zmluvy zo strany kupujúceho musia byť produkty vrátené predávajúcemu nepoškodené, úplné, nespotrebované (a to ani čiastočne) a neopotrebované. Predávajúci bez zbytočného odkladu vrátené produkty skontroluje. Ak vrátené produkty budú poškodené, neúplné, spotrebované (čo i len čiastočne) alebo opotrebované , vznikne mu u kupujúceho nárok na náhradu škody.

Nárok na náhradu škody je predávajúci oprávnený jednostranne započítať voči nároku kupujúceho na vrátenie kúpnej ceny.

V prípade, že produkty budú vrátené predávajúcemu nepoškodené, úplné, nespotrebované (a to ani čiastočne) a neopotrebované, predávajúci vráti kupujúcemu plnú sumu za vrátené produkty.

Záväzky uhradiť platby musia byť splnené do 30 dní. Lehota pre kupujúceho začína dňom, kedy poslal zrušenie kúpnej zmluvy alebo zaslaním produktu, pre predávajúceho začína plynúť dňom ich doručenia predavajucemu.

D Všeobecné informácie

1. Prosíme kupujúcich, aby sa vyhýbali možnému poškodeniu a kontaminácii produktu. Produkt zasiela kupujúci naspäť  v pôvodnom obale, so všetkým príslušenstvom a so všetkými obalovými zložkami. Je potrebné použiť aj ochranný vonkajší obal. Ak kupujúci nemá pôvodný obal, produkt treba opatriť vhodným obalom a zaslať ako balík s primeranou ochranou proti poškodeniu pri preprave.

2. V prípade zasielania produktu naspäť prosíme kupujúceho vopred o úhradu poštovného, ak má byť poštovné hradené kupujúcim.

3. Vezmite prosím na vedomie, že vyššie uvedené body 1 a 2 nie sú podmienkou pre účinné uplatnenie práva na odstúpenie od zmluvy.

E Osobné údaje a ochrana osobných údajov

1 Anonymný zber dát

Osobné údaje kupujúceho v rámci kúpnej zmluvy budú zdieľané s pracovníkmi prepravnej spoločnosti zodpovednými za dodanie produktu, a to v rozsahu potrebnom na dodanie tovaru. Platobné údaje kupujúceho budú použité iba ako súčasť vysporiadania platieb oprávnených osôb a inštitúcií.

4 Cookies

5 Použitie Google Analytics
